The training courses offered by Uwe Nittel have been designed to give the participants some insights into the fascinating world of motor sports. Participation in courses organised by Uwe Nittel is subject to the following terms and conditions:
With their registration participants confirm that they are not aware of having any illnesses or health disturbances which could interfere with their fitness to drive. Participants also confirm that they are holders of a valid class-3 driving licence. They undertake to inform the instructor(s) about any revocation or invalidity of their driving licence. They also undertake not to consume any alcohol, drugs or medicines that might interfere with the driver’s fitness to drive before or during the course.
2.1. Participants will be briefed about how to use the cars and about the local rules of the training. During the exercises they will also be supervised by professional instructors. Participants will also be briefed on the inherent risks concerning liability and injury, which cannot be ruled out completely in spite of professional preparation and running of the training.
2.2. Participants are obliged to adhere strictly to the commands and instructions of the organiser respectively the organiser’s representatives. Participants who disregard instructions can be immediately excluded from further participation. In such a case the respective participant will have no claim whatsoever to demand partial or full repayment of the course fee.
Uwe Nittel reserves the right to defer or cancel the course if objectively justifiable reasons make this necessary. In this case participants will only be entitled to repayment of their course fee; any further claims will not be acceptable. Objectively justifiable reasons could be force majeure, thunderstorms, illness of the organiser or instructor, technical problems with the training tracks or similar incidents which make it impossible to hold the course.
4.1. With the registration participants waive all their rights to claim damages from a) the organiser, Uwe Nittel, b) the instructors, c) the owner(s)/proprietor(s) of the training cars, their keeper(s) or producer(s), d) the Verkehrssicherheitszentrum am Sachsenring GMBH & Co., e) the operator of the training track, f) the safety personnel, g) the authorities, h) the ADAC respectively its regional organisations, i) the promoter, or any other third parties that have been involved directly or indirectly in the event; however, the waiver covers neither damage caused by gross negligence, deliberate action or neglect on the part of the aforementioned persons or those working for them or on their behalf nor any cases of injury to life, body and health.
4.2. Participants are expressly advised that there is neither third-party insurance nor an insurance for specific car parts. There is also no other coverage, e.g. no partial or fully comprehensive insurance for damage to oneself, others or cars. No personal accident insurance is taken out for the participating drivers or for passengers.
Participants have the right to withdraw from the contract. In case of withdrawal the following cancellation fees will be applied:
There will be no cancellation fee if the organiser is answerable for the withdrawal. All withdrawals have to be declared in writing.
Participants are liable for the full amount of damage, attributable to their negligence or deliberate actions, to training vehicles, other facilities and equipment provided by the organiser, and third persons participating in the training.
If any of the above clauses should be or become non-effective, the other parts of the agreement will remain in force.
Original jurisdiction for all disputes arising from this agreement rests with the court in Ellwangen/Jagst; the applicable law is that of the Federal Republic of Germany.
Any changes to this agreement have to be made in writing to be effective.
